Thousands fail background checks for Uber, Lyft

State officials in MA said more than 8,000 people who applied to drive for ride-hailing companies, like Uber and Lyft, in the Bay State have failed a required background check.

Gearhart: "We're disappointed with the fact that the companies would rather take the City of Seattle to court than sit down and negotiate with their drivers and start improving their working conditions".

The case is Chamber of Commerce v. Seattle, 17-cv-00370, U.S. District Court, Western District of Washington (Seattle).

Brooke Steger, general manager for Uber in the Pacific Northwest, had a similar sentiment.

San Francisco-based Lyft has been in fundraising mode for some time as it spends heavily to compete with its much bigger rival Uber Technologies Inc.

Disclosing that sensitive information could hurt the companies by potentially making it available to competitors, the chamber said.

"It's not like the Teamsters could take this list and go put it online", Michael Ryan, an assistant city attorney, told Bloomberg BNA. The ordinance prohibits qualified driver representatives from using it for any goal other than organizing.

The LA City Council approved a plan in December 2015 to allow ride-hail companies to pick up passengers at the airport. A federal judge dismissed the lawsuit because the ordinance had not yet gone into effect.

Seattle's law "turns labor law on its head, treating independent businesses as employees, and flouts antitrust law, allowing independent economic actors to fix prices", the chamber argued in a legal filing in its federal lawsuit attempting to block the measure.

In his written order, Lasnik said the Chamber's argument relies on a "coincidence of timing" related to the history of the NLRA, and that the city was likely to prevail in that specific argument. "We have a chance to fix the current system in the rules process so that people who deserve to work are not denied the opportunity", a spokeswoman for Uber said in a statement.
